Complaints Policy

We take all matters involving content integrity very seriously. The following information outlines how we go about handling your reports. This sets out our Complaints Policy, which you agree to be bound by as a user of the ITC Media Inc. Website inthecrack.com.

This Complaints Policy is inclusive of and in addition to our standard Policies & Rules, to which you are also bound as a user of the ITC Media Inc. Website inthecrack.com. Please note, you do not need to be a user of the ITC Media Inc. Website inthecrack.com. in order to submit a complaint, any concerned party may submit a properly formatted and substantive complaint as discussed below.

When you submit a properly initiated and substantive complaint, it will be resolved within seven business days of our receipt of the complaint. Here “business days” are defined as any day which is not a Saturday, Sunday, or public holiday in the United States.

How to make a Complaint

If you wish to make a complaint about content appearing on inthecrack.com you may submit a report to support@inthecrack.com - though please only submit one such report per instance in order for us to best process your issue. When submitting such a report, please include at minimum the following information:

Note: Do not submit more than one report per issue or occurrence. Multiple reports will complicate our efforts to properly research the matter and will not speed up our investigation and response.

Once we receive a complaint which includes all necessary information as detailed above or by the nature of the complaint, we will respond to the report within seven business days. We have a rigorous process in which a dedicated team reviews the reports which receive, this is discussed below.

How we handle Complaints

The manner in which we handle a complaint is directly dependent on the nature of the report we receive in addition to the amount of information was provided in that report. In general, where a report provides the necessary information for us to properly investigate the matter we shall proceed as follows:

Unjust or Abusive Complaints

Please note, that all information contained on this page is subject to a good faith standard, both on our part and yours. All individuals, regardless of status as a user of the ITC Media Inc. Website inthecrack.com., agree by submitting a report that they do so under good faith. This is a legally enforceable promise on your part. “Good faith” implies that you will not submit any complaint which you know to be unjustified, abusive, fraudulent, inaccurate, or otherwise made in bad faith. Repeatedly submitting reports based on the same issue or occurrence is a violation of the requirements of this Complaint Policy and may also be interpreted as acting in bad faith. If we, at our sole discretion, determine that you or an entity acting on your behalf have breached this policy by acting in bad faith, we may suspend or terminate any associated user accounts as well as seek full action against you to the extent allowed by law.

Complaint Policy & Takedown Procedures

For copyright-related takedown requests, we have a special page dedicated to these requests. On receipt, we will review and disable the content if appropriate. We will ask for supporting documentation to illustrate that we are or are not infringing on someone else’s intellectual property. We reserve the right at our discretion to remove content. Following receipt of your complaint of illegal or non-consensual Content we will take such steps as we consider to be appropriate to resolve your complaint within 7 business days. If we require further information or documents from you, we will contact you to let you know. We will in good faith investigate your complaint and take the following action: If we are satisfied that the Content is unlawful or non-consensual, we will immediately remove such Content, and we will notify you of our decision by email or other electronic message. If we are satisfied that the Content is not unlawful or non-consensual, we will notify you of our decision by email or other electronic message. Any dispute regarding our decision on non-consensual content will be submitted by us to a neutral arbitration association at our expense. Reporting will be uploaded on a monthly basis to the portal.

Prohibited Content

ITC Media Inc. has established controls to prevent prohibited content from being published to our website inthecrack.com.

Age Verification, Uploading of Content, Downloading of Content.

Before any model content is posted on our website, they must go through a manual review and provide documentation, including a photo of valid ID illustrating they are above the age of 18. They must also provide a photo of themselves holding the ID. After they get through that approval, the content may then be posted. Before content is posted, it is manually reviewed and approved by us before it goes live. Should there be another person in the video we will request documentation on anyone else appearing in the video with proof or an attestation they have full publicity rights on that other person.

Before content goes live, content is reviewed to ensure we have documentation on everyone appearing in the video, and whether it violates our Community Guidelines. We have 24/7 moderations checking all content.

Our Terms state that inthecrack.com retains the right to reproduce, distribute, and produce the content in any manner whatsoever, which includes the use of downloading. The Broadcasters determine how content is accessible on the platform to other users, and thus are in control of who can download what content. For example, some content is only available to users for free. Other content is available to subscribers, who pay a monthly fee or a one-time fee.

Prohibited Words for Marketing and Traffic

The Company’s traffic and media buying teams also maintain a list of prohibited words, used to identify any content related to child pornography, sexual exploitation of children, sex trafficking, human trafficking, prostitution, the depiction of nonconsensual activities, or any other illegal activity. With this tool, we aim to ensure that the Company is not buying advertisements or receiving traffic from sites that appear to promote or foster such content and that external marketing content and search terms do not give the impression that any such content is present on the Company’s Platform. The Prohibited Words list is regularly reviewed and updated in order to ensure compliance with the latest applicable laws and Regulations.

Safety and Anti-Human Trafficking Policy

ITC Media Inc. has a zero-tolerance approach to human trafficking, sex trafficking and physical abuse. We ask our users to be sure to respect others human rights. We strongly disapprove human trafficking, sex trafficking and physical abuse and have implemented strict policies to prevent these activities on our website. Furthermore, we support the anti-human trafficking initiative by being a member of the association of Team Freedom - AtlasFree.org as well as followers of The Association of Sites Advocating Child Protection (ASACP) and of the Pineapple Support.

  1. Prohibited activities:
    ITC Media Inc. strictly prohibits any form of human and sex trafficking and physical abuse on the website. Broadcasts featuring such activities, even in the form of role playing, will be immediately suspended and user accounts involved will be disabled indefinitely. Appropriate legal actions will be taken, if necessary.
  2. Reporting:
    Users, moderators, viewers or any other individuals who encounter content or activities related to human trafficking, sex trafficking, or physical abuse on inthecrack.com are strongly encouraged to report such instances promptly. We receive such reports via email at support@inthecrack.com. Our team will mark such reports as high priority and will take immediate actions to prevent human trafficking, sex trafficking and physical abuse.
  3. Cooperation with law enforcement:
    ITC Media Inc. is committed to fully cooperate with law enforcement agencies in investigating individuals involved in human trafficking, sex trafficking, or physical abuse. We will provide any necessary information and assistance to authorities as required by law.
  4. Content Moderation:
    To prevent the misuse of our platform, our website makes use of robust content moderation techniques and technologies to detect, remove, and prevent any content related to human trafficking, sex trafficking, or physical abuse. Our moderation team is trained to identify and promptly act upon such violations.
  5. User verification:
    Merchant implemented user verification processes to ensure the legitimacy of user accounts. This includes identity verification measures and periodic reviews to prevent the use of fake or compromised accounts.
  6. Compliance with laws:
    Site name complies with all local, national, and international laws related to the human trafficking, sex trafficking and physical abuse.
